(1/x) This thread is going to address #TPS (temporary protected status). Not sure it rises to the level of #FakeNews, but lots of reporters clearly do not understand a basic fact about #TPS – namely, that it is for people who are already in the United States...
#TPS is NOT for people who want to come to the United States. Reporters keep asking why we won’t use #TPS to let Bahamians in who were affected by #Dorian. The most basic answer is #TPS isn’t used to let people in…
(3/x) #TPS is to allow them to stay here when something happens in their home country while they are visiting (e.g., a natural disaster or war breaks out). But as long as we’re talking about #TPS...
(4/x) ...let me take a moment to also let you know that there are Courts in this Country violating the law by blocking the administration from ending TPS in various cases (remember, “T” is supposed to mean “temporary”)...
(5/x) It may sound strange to you to say that Courts are violating the law (and the separation of powers), but this is actually pretty darn clear.
Congress gets to define the jurisdiction of Courts (i.e., what sorts of cases the courts can hear), and ...
(6/x) ...Congress made it explicitly clear that the Courts ARE NOT ALLOWED to touch #TPS decisions. Here’s the language from 8 U.S.C. §1254a(b)(5)(A): ...
(7/x) “There is NO JUDICIAL REVIEW of any determination of the [secretary of Homeland Security] with respect to the designation, or termination or extension of a designation, of a foreign state under this subsection.”
(8/8) Until the Courts start obeying the law again and leaving these decisions to the executive branch – as Congress explicitly stated in the law – I certainly won’t recommend the use of #TPS
