Sounds like if they tried this it'd end up almost immediately in court, which is what some inside govt expect - but who knows if this is plan -one Cabinet minister told me earlier they hadn't the 'faintest clue', how govt thought they could get round it + stick to Oct 31 deadline

1. PM spoke to Merkel at 8am this morning - No 10 source says she said there could only be a deal if Northern Ireland stays in Customs Union, if not, then deal is 'overwhelmingly unlikely'
2. No 10 says PM stressed to Merkel UK believes they had put forward a reasonable new deal, but with no desire to engage on EU side + this demand on NI staying in Customs Union a deal is 'essentially impossible'
3. No 10 source says 'talks in Brussels are close to breaking down, despite the fact the UK has moved a long way' - today's 8am call described as a 'clarifying moment'

1. Senior No 10 source still claims they can avoid delay - source tells me ’The government will comply with the Benn Act, which only imposes a very specific narrow duty concerning Parliament’s letter requesting a delay' ...
2. Senior No 10 source on Benn Act cont 'drafted by an unknown subset of MPs + pro-EU campaigners) +which can be interpreted in different ways, but the govt is not prevented by Act from doing other things that cause no delay including other communications, private and public.'
3. 'People will have to wait to see how this is reconciled. The Government is making its true position on delay known privately in Europe and this will become public soon.’... the quest to hunt the 'other things' that govt will try to avoid the delay continues

At end of a big day - seems Johnson's proposals being greeted with unlikely, but maybe - concerns about DUP having veto, leaving issues unresolved until transition, lack of detail on customs checks and disruption for NI even if customs checks take place no where near the border
No 10 will be relieved EU hasn't said a big fat no immediately, and hints from Brexiteers, DUP and a trickle of Labour MPs saying they might sign on the dotted line - but blimey, it's a hell of a lot to imagine being sorted in 10 days
And with option of delay on the table, it seems, right now more likely, the EU will decide to wait and see- extension/election/new world - if Tories are biggest party maybe these proposals would be start of next negotiation - if not, then there is a chance Brexit might not happen

Ok new thread to keep things clean. Lord Pannick is explaining that Gina Miller's legal challenge is focused in on why the PM needs to close Parliament for five weeks ahead of a Queen's Speech - longest for 40 years - just as the Brexit clock ticktocks towards midnight.
He asks: Is the five-week closure reasonable to meet the objective - which is to close a Parliamentary session ahead of a Queen's Speech. "It is not manifestly necessary to have a five-week prorogation," he says.
"It is not merely that it is a prorogation of an exceptional length at a critical time & that the PM can provide no reasonable basis for needing it. This case involves a decision by the PM that is *fatally infected* by the PM's failure to understand that Parliament is sovereign."

I'm doing a Brexit update lecture for my EU law students on Thursday morning. It is difficult to know what to say. It is difficult to make sense of the situation the UK finds itself in - 10 days before 'Brexit day' any of these outcomes could happen. 1/
1. The legal default is no deal. Unless something else is agreed, the UK will leave the EU on March 29 without a deal. 2/
2. The UK could (and legislation is probably required for this) revoke A50, and decide to remain in the EU. So far, so easy. But, for most MPs, no deal and revoke are not good outcomes. 3/

You could put an aspirational 2022 date for a new arrangement to enter force, but ultimately this is about the reality of international negotiations taking time meeting the fantasy of the UK immediately striking get rich quick trade deals (which aren't in fact) 2/
If it is true that on the major policy question the PM has decided to maintain a close economic relationship with the EU then that logic has to be followed - and a deal can be struck on that basis. Let's see what the next few days brings 3/
