Judges in Scotland’s highest civil court have said they will continue the case brought by petitioners seeking a ruling to compel prime minster to send a letter to EU asking for an extension to Brexit if no deal in place until October 21st
Those who brought the case say they are pleased with the result. They say it is giving the pm to comply with his obligations under the law.
Those who brought the case say they are pleased with the result. They say it is giving the pm time to comply with his obligations under the law. So in a sense a win for both sides ..
In his statement Lord Carloway agreed with earlier ruling that said no reason for granting an order. He went on to say situation remains fluid and circumstances may change over next two weeks. Ruling means petitioners can return to court without having to start new proceedings
So to be clear the Benn Act compels the PM to act for an extension to Brexit if no deal is in place by October 19th, so judges have said they will continue consideration of reclaiming motion and petition to nobile officium until 21st October.
