This is a really interesting question with (for me) no obvious answer. I acted for a (amateur) grime rapper a few years ago in a gang injunction case where the police tried to use his YouTube lyrics as evidence for the order. Judge wasn't that bothered by the Art 10 arguments!

Then the government said they needed stronger laws in part because of this case and slipped them through parliament with almost no scrutiny. Sometimes winning is losing too!
On the day of the High Court appeal the judge asked me if I had seen that morning's Times, where an article had been mischievously placed I imagine by the Home Office thetimes.co.uk/article/gang-l…
