UPDATE: EISENBERG has retained attorney Bill Burck — who repped McGahn/Priebus. Bannon during the Mueller probe.

Burck says Eisenberg would testify if a judge ruled that he had to in a related matter brought by Charles Kupperman.

MORE: Burck cited a Justice Department opinion that declares Eisenberg "absolutely immune" from testifying due to his proximity to Trump. That opinion says the immunity applies even in an impeachment probe. politico.com/news/2019/11/0…

Also, if you're not Adam Schiff, Devin Nunes, Steve Castor, Dan Noble or Dan Goldman, chances are you'll have very little role in the impeachment harings. Schiff makes clear members won't get their 5 minutes of questioning until the extended questioning by these five is done.

COOPER says Senior State Dept. / Pentagon officials questioned whether the president had the legal authority to block congressionally approved Ukraine aid without notifying Congress.
COOPER believed that Ukraine military assistance had to be out the door by Aug. 6 or else it might not be out in time for the end of the fiscal year -- a breach of Congress' legally required appropriation.

Bannon's attorney, Bill Burck, was relaying House Intel Cmte Q's to the White House in REAL TIME.

Burck also represents WH Counsel Don McGahn. It's likely Burck was communicating with McGahn.

A strong case can be made Burck is conspiring with his clients to obstruct justice.
Just a reminder that during Watergate, your likelihood of going to prison was MORE likely if you were a lawyer...
While it's not confirmed with whom Burck spoke at the White House, a claim of executive privilege should be approved by someone in the White House Counsel's office; it was either McGahn or someone that works for him.
