Judge Rosemary Collyer, the chief judge of the court that approves FISA surveillance, says shortcomings in the government's application to wiretap Carter Page were "antithetical to the heightened duty of candor" that is required in surveillance applications.
Earlier this month, the surveillance court asked for information about an FBI attorney who the Inspector General said had altered an email describing Page's interactions with the CIA.
Judge Collyer: "the frequency with which representations ... turned out to be unsupported or contradicted by information in their possession, and with which they withheld information detrimental to their case" raises broader questions about the FBI's FISA applications.
Judge Collyer ordered DOJ to submit a sworn declaration by Jan. 10 listing the steps it's taken to improve the vetting of FISA applications. And she ordered it to complete a declassification review of a separate order about a doctored email by Friday.
