Putting a thread to tell facts of CAA and the NRC which ARE mutually exclusive. The protests/violence is inconsequential. I will detail why.

CAA is Citizenship (Amendment) Act 2019. It applies only to those citizens of the PERSECUTED MINORITIES from the countries of Pakistan, Afghanistan and Bangladesh. It is NOT applicable to Indian Citizens.

This amendment is completely constitutional because both the houses of the Parliament of India have passed it and it has the assent of the President of India.

The basis of these protests(hopefully) is that CAA will act as a primer to the planned creation of the National Register of Citizens (NRC). I will also detail police's action that is called inhuman in the later part of the thread.

The CAA mandates that it shall give citizenship to these people from persecuted minorities of those countries if they have been in India from on or before 31.12.2014.

If you do read the Citizenship Act, 1955/2003, it says a person who applies for citizenship on basis of naturalization, needs residence in India for 11 years. This amendment will allow those from persecuted minorities to be allowed citizenship in 5 years instead of 11.

Why are Muslims not included in this? Because this act is meant to give citizenship for minorities of Muslim majority countries.

Other than that there's nothing at all anti-Muslim as being projected.

That is all CAA is. It is NOT applicable to Indian citizens. You and me cannot use it at all.

The list of documents required to prove you are a part of the persecuted minorities from the countries of Pakistan Afghanistan and Bangladesh is yet to be notified as per rules.

Now to the NRC that people are protesting. The NRC in Assam is governed by the Assam Accord of 1985. The NRC nationwide will be governed by a law that shall be introduced (final draft not ready yet). It has picked a draft from Census 2011.

The basic premise of the NRC nationwide will be that the onus of proof of illegality lies on the government. Unlike the Assam NRC where the onus is on the citizens to prove their legality.

The law is yet to be drafted.

Next myth: Hindus will use CAA if excluded from NRC but Muslims can't.

Truth: Neither can use CAA. It is not applicable to Indian citizens. In the NRC, default is you are assumed to be an Indian citizen until the government can prove otherwise.

The NRC Act and Rules when drafted, passed by both houses of Parliament of India and assented by the President of India and notified in the Gazette of India shall govern how the government can prove you to be illegal and how you can disprove that claim.

I wish people wait till CAA rules are notified and the NRC draft is ready and then pick if there is anything related to religion/caste/creed.

Police have been very restraint. Imagine someone hitting you with stones and you not being able to retaliate. Hope the pelters think if your father was on duty and you're pelting at them, how'd you react? It's just human nature. Riots don't solve anything.

Violence is waste of time and taxpayers money. Hope those with vested interests stop. We need peace. None of those made up issues are actually issues.
