Withholding of Removal is a persecution-related form of relief from deportation, often for people who believe they will be disappeared, tortured, or killed upon a return to their country of origin.
Getting a passport by fraud in a third country to facilitate your departure supports a finding of firm resettlement. I just... Ugh.

You must prove that the third country is going to catch onto the fraud?
An absolute railroading of a pro se asylum applicant, getting him to "not contest" DHS's statement that he had become an Angolan citizen.
But he ultimately prevails on one argument, winning remand. But ICE couldn't wait for his appeal of right to be decided and deported him a few months ago. Whoops.

What a travesty.

New published Board of Immigration Appeals decision today.

It is jaw-dropping.

He was struck by officers carrying high-caliber weapons, dislocating his shoulder, cuffed, and told that they were going to cut his fingers off and that they'd gauge out his eye.

BIA says this is not severe enough mistreatment to rise to level of persecution.
BIA upholds IJ finding that applicant failed to meet burden to show that the men who showed up in police uniforms w/ high-caliber weapons and handcuffs were actually cops...

Because he didn't prove that the uniforms weren't fakes & it is common for criminals to carry weapons.

As #impeachment dominates the news cycle the war on #asylum still rages... and the Trump administration just dropped another daisycutter.

This whole thing is *far* worse than this headline might suggest, so let's just into it.
2/ 1st, remember that "criminal aliens" is one of the Trump administration's favorite phrases, intentionally used to associate crime w/refugees, asylum seekers, &Central Americans generally. (MEDIA: This is a very knowing psy-ops campaign; please don't perpetuate it)
3/ International law *does* allow member states of the Refugee Convention to restrict the right of asylum to those convicted of "particularly serious crimes" and even return such people there even knowing they face will face persecution. It's clearly for extreme cases.

Vote Leave promised EU citizens that they will be treated no less favourably than they are at present.

Now that we have a #BrexitDeal with the EU in form of the Withdrawal Agreement (WA) it is time to check whether Vote Leave told the truth.
2/ Free movement for British citizens living in the EU
The WA only protects rights for British in Europe in their country of residence, their continuing free movement rights have been taken away.
3/ Lifelong right of return for EU citizens in the UK
The WA only insists that rights may lapse after an absence of a minimum of 5 years, and the UK has chosen to use this minimum. Other member states may well do the same.

Even worse was a mom who came to the US with her daughter “Celia” (not her real name). Her other daughter had been kidnapped by the gang a month ago and never seen again. The gang said Celia was “next,” and threatened to kill the rest of the family, so they left.
It’s taken me a while to write about the time I spent with the Dilley Pro Bono Project at the immigrant family detention center. It’s difficult to put into words the jarring mix of hopefulness and fear, the moms waiting for news and the laughter, crying and sniffles of children.
