The Dutch state lost the case (I conclude after a quick glance at the conclusion of the judgment). Link to judgment uitspraken.rechtspraak.nl/inziendocument…
Dutch SyRi case: press release of the court rechtspraak.nl/Organisatie-en…
SyRI, automated fraud detection system in the Netherlands, breaches Art 8 of the European Convention on Human Rights, says Dutch court. SyRI’s interference with right to privacy is not proportional, says court
Dutch court says it applies art 8(2) of the European Convention on Human Rights, while taking into account the principles of art 5 GDPR #SyRI (6.41)
#SyRI This is the first Dutch judgment that I know that discusses the Kafka provision, art 22 GDPR on automated decision-making. 6.56
Court emphasises that SyRI’s lack of transparency makes it too difficult to assess whether SyRI includes sufficient safeguards 6.86 - 6.94 #SyRI
All in all, I’m very happy with the #SyRI judgment: a win for privacy, and important remarks about the need for transparency of government systems.
I guess we can expect the Dutch state to appeal, like it did (until the Supreme Court) in the Urgenda case

OK, enough excitement - back to exam grading
