So since everyone’s talking about eugenics, here’s some fun legal history for everyone!

Buck v Bell (1927), where Justice Oliver Wendell Holmes wrote “three generations of imbeciles are enough” - has never explicitly been overturned in the Supreme Court.
Skinner v Oklahoma (1942) reached SCOTUS and overturned Oklahoma’s Habitual Sterilization Act of 1935. It didn’t particularly address disabled people but its reasoning was used to undermine the Buck v Bell decision.
Under Buck v Bell, nearly 70,000 Americans were forcibly sterilized:

American eugenics emboldened the Nazis. Aktion-T4 was how Nazis exterminated and killed disabled people. Mengele did terrible things. We gave ideas. Buck v Bell inspired the Nazis.

At the Nuremberg trials, lawyers for Nazi scientists cited the opinion in defense of their actions
American eugenics occurred after World War II and the Nazi atrocities. American eugenics forcibly sterilized

Virginia had eugenics boards and forced sterilization until 1979.

North Carolina had eugenics boards until 1974. The state also had a law surrounding forced sterilization of disabled folks that my former boss critiqued as a young lawyer in 1996 (his critique now appears in a bioethics law book):

There’s a Bush appointee in the 6th Circuit who thinks that coerced sterilization of incarcerated people in exchange for a reduced sentence is just “free contraceptive service.” #TeamLegal
And given this country’s history of forced sterilization in communities of color and for people with disabilities, I think it’s time we all start freaking out.

Someone recently was asking me whether I thought these abortion restrictions are about increasing white birthrates. They said, but it would increase black and brown birth rates too, right? So how does that make sense?

With this news out of Canada that doctors have been sterilizing indigenous women without their consent, it's a good time to recap some of the history of eugenics/racism and its relationship to statistics. Mute/unfollow if uninterested; this is long.

Francis Galton, the founder of modern statistics, was a huge racist who also invented the word “eugenics.” One of his first statistical works, Hereditary Genius, was about the degree to which genius runs in families. He also tried to use statistics to rank the various races.
He believed almost every characteristic of people was hereditary, and that society could be improved by encouraging selective breeding among the “best” people, meaning, for Galton, Anglo-Saxons.
