[BREAKING] Supreme Court dismisses review petitions challenging 2018 Aadhaar judgment; Justice DY Chandrachud dissents


The majority judges held that no case is made out for review of the Court's September 2018 judgment which had upheld Aadhaar including passage of Aadhaar Act as money bill.

Justice DY Chandrachud, however, dissented citing another 5-judge Bench ruling which had expressed doubts on correctness of Aadhaar verdict with regard to issue of passage of Aadhaar Act as money bill. It had therefore referred that legal issue to a larger Bench.

Justice Chandrachud, therefore, held that judicial discipline and ends of justice require that review petitions be kept pending till a larger Bench settles the legal issue regarding certification of bills as money bills.

Majority judges have, however, held that subsequent decision by a coordinate bench cannot be ground for review.
