Justice Shinde: With all humility and human considerations, we are of the opinion that this is a fit case for allowing the relief.
Justice Shinde: We feel that with the condition of the under trial, it would be inappropriate to send him back. It would be appropriate to impose such conditions.
Justice Shinde: The undertrial is to be released on bail for a period of 6 months.
Justice Shinde directs that Rao has to stay within the jurisdiction of the Special NIA Court.
He would not indulge in any activities or similar activities which led to the registering of the FIR.
Justice Shinde: On the completion of the 6 months Rao has to report back to Taloja Prison.
ASG seeks for a stay of 3 weeks.
Justice Shinde rejects the prayer on the ground that Nanavati has declared him fit to be released and since he cannot be sent to prison, he has to be released.
Justice Shinde: Rao has to attend trial whenever necessary, but can apply for exemption from physical appearance.
Justice Shinde: We are of the opinion that this is a genuine and fit case to grant relief or else we will be abdicating our constitutional duties as protector of human rights and right to health covered under right to life of article 21 of the constitution.
Justice Shinde: We feel that although material on record does show that the health condition of undertrial is precarious, we feel that sending him back to where he belongs is fraught with the risk of his presence being used by those allegedly associated with him.

Bench of Justices SS Shinde and Manish Pitale of #BombayHighCourt will give their verdict in the appeal filed by NIA challenging the bail granted by the Special NIA Court Mumbai to the person accused of joining the global terrorism outfit (ISIS).
Majeed, who travelled to Syria to allegedly join ISIS, was arrested in November 2014 under the UAPA after he returned from Syria. The lower court granted him bail on merits last year.
Matter was reserved for orders by High Court on February 5, 2021.
