Supreme Court bench led by Justice DY Chandrachud to hear plea by TV5 & ABN Andhra Jyoti channels seeking #contempt of court action against AP government for filing FIR against them after they carried "#COVID19 related news" @tv5newsnow@ABNJyothyTV@ysjagan@RaghuRaju_MP
Divan: FIR is on page 81. There is reference to an inquiry report which begins at page 83. it was submitted that what is happening in this case is an assault on an television channel without a case
Divan: Please see the platform from where inquiry report picked up the videos. Its from facebook, youtube etc. These videos are pulled out from social media.
Divan: so far as i am concerned, its conspiracy that has been highlighted. inquiry report is an assault of free speech. duty of tv channel is to show point of view irrespective of however harsh it is
Divan reads the FIR: speeches of Raju were said to seditious and evoking hatred. 2 media houses were said to be conspiring with Raju and airing videos on pre determined slots showing a well planned conspiracy
Justice Rao reads the Telugu words: It says the person who made the statements stated that people will be disrobed and kicked. Mr Divan is right it is like muzzling the media
Justice Chandrachud: Plea for contempt have been moved by TV5 and ABN news channel. FIR says a suo motu case was instituted based on a inquiry report by the state CID Mangalgiri.
Justice Chandrachud: The germane of allegation arises from certain program which was broadcasted involving participation of @raghuraju. Mr Raju is first accused and the tv channels are the rest of the accused. Mr Divan says the FIR is to muzzle the electronic media
Justice Chandrachud: The FIRs do not establish the offence invoked against them. Article 32 jurisdiction has been invoked saying our earlier order stated that contempt would be issued if coercive arm of law is used against free speech
Justice Chandrachud: Till the next date of listing there shall be stay on coercive action against the two tv channels and their personnel.
Senior Adv Luthra: this is really a case for stay of investigation. Please consider it.
Justice Chandrachud: we will not stay investigating but we will stay the coercive action. It will be tagged to the writ petition seeking to quash the FIR
Justice Chandrachud: We are of the view that provisions of 124A and 153 of IPC require interpretation, particularly on the issue of the rights of press and free speech
