#BombayHighCourt bench of Chief Justice Dipankar Datta and Justice Girish Kulkarni begins hearing a petition filed by .@DhrutiMKapadia seeking door-to-door vaccination. The state govt today is likely to respond whether it would allow door-to-door inoculation or not.
AGP Geeta Shastri for state - We need a week's time as the state task force has submitted the guidelines to the government yesterday. We need to take a decision on the same.
.@DhrutiMKapadia seeks copy of the guidelines.
CJ Datta points out that state has refused to serve the copy to anyone as of now.
Bench is going through the guidelines now.
CJ: You (state) require one weeks time to finalise the policy?
AGP Shastri: Yes, for taking a final decision on this.
AGP Shastri: We have also annexed the opinion of expert doctors in this regard.
Bench is reading the guidelines submitted by Shastri.
CJ: You have given the guidelines to us. Now share it with the parties. Would you want to hear some positive points from the bench?
AGP Shastri: I leave it for the bench to comment.
CJ to .@DhrutiMKapadia : The guidelines are still at a draft stage. Let us not fall back to a policy of 2010. This is a special disease thus special care needs to be taken. (Kapadia had highlighted the earlier vaccination policy)
Bench dictates order: State has submitted guidelines. The govt is yet to approve it. The guidelines would be shared with the parties in the present proceedings once the state approves it.
Bench: Prima facie we record that the task force has been proceeding in the right direction. We however, leave it to the task force to explore room for incorporating some more points that it would be beneficial for the elderly and bedridden.
Bench: The state would be in a position to spell it out whether it would allow it in one week. Matter adjourned for a week.
ASG Anil Singh, appears for the centre, and points out certain paras of order passed by the bench in the last hearing on the advisory of the Union govt against door-to-door vaccination drive, and seeks clarification
The bench had then said that the advisory of the centre wasn't prohibiting states like Kerala, J&K etc from proceeding with door-to-door vaccination drive
Bench asks centre to submit its guidelines on near to home and against door-to-door vaccination drive on next hearing. Matter adjourned for a week
