1. The case assumes we correctly notified the EU that we wanted to leave the EU. (Another case crowdjustice.com/case/a50-chall… challenges that assumption. I have no involvement in that other case).
2. My case looks at the other end of the process. It asks how, if Parliament decides it wants to stay in the EU and withdraw that notification, it can.
3. As things stand, to withdraw our notification, we need permission from the other 27 member states. I show that here
4. It is good we can withdraw our notification but it is better we can do it without needing anyone's permission.
5. It is better for three reasons. First, the decision whether to remain in the EU should be for us to make not other countries. We should control our destiny.
6. Second, we don't know what price tag the EU may attach to permission. We may be asked to give up our rebate. This may make it harder for MPs to vote to stay.
7. Third, we need to look at what MPs will be asked to vote for. Will they be asked to vote to ask for permission to stay in the EU? Or will they vote to stay in the EU? One is much easier for MPs to vote for than the other.
8. If MPs can withdraw our notification without needing to ask permission all these difficulties disappear. The path to staying is made easier.
9. This is vital. Only yesterday Jeremy Hunt talked about the possibility of us remaining. Only yesterday a poll showed 60% support for a second referendum. And it is urgent - we need to act now to get an answer in time.
