I'm back in court for #UberWaymo where Travis Kalanick is expected back on the stand within the hour forbes.com/sites/bizcarso…
We're back in session, and the lawyers are debating about board member Bill Gurley's testimony. Jury is not in the courtroom yet while they sort of these kinds of issues #UberWaymo
Somehow we're AGAIN talking about the Greed Is Good video that Waymo wants to show. It's amazing the amount of time being spent on this YouTube video. #UberWaymo
I'm still baffled that Waymo is fighting so hard for this. And now Uber's lawyer is telling the judge that Waymo's lawyer is misleading the court when he keeps saying 'wink wink' when it was just an emoticon. Glad this trade secret case is devolving into emoji and YouTube debates
Waymo wins and gets to play it. Judge Alsup says he doesnt know if it's a good use of their time, but here we go. #UberWaymo
Travis Kalanick is officially on the stand. Here we go. forbes.com/sites/bizcarso…
Kalanick agrees that he knew it was a risk that Google/Waymo could sue as a result of the Otto deal. "I think there’s lots of risks in a deal, that’s certainly one of them." #UberWaymo
Email from Uber business head said "Did you tell Anthony that you would indeminify them if they get sued by G as part of or after the deal?"
Kalanick says he didn't believe he did, but Uber eventually did indemnify Levandowski #UberWaymo
Kalanick confirms that he had set up his text messages to auto-delete every 30 days and also used Telegram to talk with Levandowski, but that was "later in 2016" and not during the deal, he said. #UberWaymo
Kalanick sent Anthony Levandowski a text on March 1, 2016. "1. Burn the Village."

Levandowski later said "Yup."

Kalanick (nor the audience) has any idea what that means. #UberWaymo
Levandowski texted Kalanick "I just see this as a race and we need to win, second place is first looser (sic)"
Kalanick says he first heard the quote from his football coach and it's quote he agreed with. #UberWaymo
“We do need to think through the strategy to take all the shortcuts we can find” Levandowski texted Kalanick.
Kalanick oesn't think that it was specific about Lidar, but about autonomous technology. #UberWaymo
We are FINALLY getting to the "Greed Is Good" speech text. I'm so glad we're finally about to see this. #UberWaymo
Waymo: "That's a famous speech, right?"
Kalanick: "It's a movie. It's fake."
#UberWaymo
Waymo's back at going through text messages. Levandowski had called due diligence questionnaire "dumb" and said he was squeezing his attorneys "like toothpaste too."
Kalanick doesn't remember if he squeezed his own attorneys like toothpaste. #UberWaymo
Notes from a whiteboarding session with Levandowski included the phrase "I know some shit." Kalanick denies that had anything to do with lasers and says it was more about opening the San Francisco ATG office and getting it to work well with the Pittsburgh team. #UberWaymo
Uber listed 2 rationales for Otto deal. First, "Lasers are critical to Uber’s AV development, and Ottomotto is expected to de-risk our current approach." Second, "Ottomotto could significantly enhance our overall AV efforts and potentially accelerate current timelines."
Deal overview presented to board showed Uber paid $100,000 upfront for the acquisition and also 12 million shares, valued at the time around $592 million, subject to hitting technical milestones. #UberWaymo
Kalanick says he never saw the due diligence report or the indemnification agreement before the deal to acquire Otto went through. Board approved it on April 11, 2016. (It was announced in August).

His signature is on the doc, but Waymo lawyer cuts him off as he tries to explain
Kalanick's vocabulary is not helping his case. Notes from meeting that sound like something he would say include:
"The golden time is over. It is war time."
"Going slower is NOT an option any more."
"Cheat codes. Find them. Use them."
#UberWaymo
Waymo ends its questions by asking Kalanick if he considered Levandowski "a brother from another mother."
He smiles.
"That's something I've said a couple times, yes."
#UberWaymo
Uber starts by asking why Kalanick hired Levandowski in the first place:
"We hired Anthony because we felt that he was incredibly visionary, a very good technologist, and he was also very charming. #UberWaymo
"How do you feel about him now?"
Kalanick: "This has been a difficult process. This makes it not as great as what we thought it was at the beginning""
#UberWaymo
Kalanick talks about how he got picked up in a self-driving car to meet with Larry Page around the time of the 2013 investment. Their relationship at the time "was kinda like little brother with a big brother." #UberWaymo
Kalanick says he first started feeling like Google was becoming a competitor in 2014 and was trying to get meetings with Larry Page to talk about the partnership. He felt they had an "understanding". When he got no response, Kalanick bought CMU robotics team to start Uber ATG.
Kalanick testifies that Levandowski never said he was going to bring Google information to Uber. #UberWaymo
Kalanick gets a bit caught up talking about Otto's trucks:
“I got to take a couple rides in them. It was fun. Sorry, I digress.”
#UberWaymo
Now Kalanick is defining "Cheat Codes": "Cheat codes are like elegant solutions to problems that haven’t already been thought of.” #UberWaymo
Tesla is one example, Kalanick says. They have people paying to drive around with Tesla's sensors, which sends feedback to Tesla.
"They’ve got people paying Tesla to help their self-driving car effort do better. We’d consider that a cheat code." #UberWaymo
We're back from the break on #UberWaymo. Kalanick is still on the stand.
Why did Uber think Google would sue?
Kalanick: "Larry was just very angry, very upset that we were doing his thing.'
He says Page was 'unpumped' about what had happened.

Yes, 'Unpumped' is going in a federal court transcript. #UberWaymo
Meeting between Kalanick and Waymo CEO Krafcik was about partnering again, he says. They didn't tell Waymo about the Otto acquisition at the time, but had Emil Michael call Krafcik when the news came out. #UberWaymo
Kalanick called Larry Page to talk about flying cars in October 2016 and reassure him that Uber was not building flying cars. He says Page was upset about Uber hiring so many Google employees. Kalanick says he told him "your people are not your IP." #UberWaymo
Waymo comes back at cross examination to ask Kalanick about his definition of cheat codes. YES, THIS TRADE SECRETS CASE IS BACK ON THE DEFINITION OF CHEAT CODES.

They don't agree and Waymo's lawyer sits down.
And Travis Kalanick is officially done and released from his subpoena. He won't be appearing in the court again.

His dad puts his arm around him as they walk out. #UberWaymo
