#DeLille has two legal arguments about remarks she made on The Eusebius McKaiser Show on 26 April.

1. She claims a proper interpretion of the words exchanged between her and the host does not support the @Our_DA interpretion.

2. Part of the DA constitution is unconstitutional.
Argument 1: De Lille says the @Our_DA quoted selectively from her interview with Eusebius McKaiser. At the end of said interview, and she cited the transcript, she said the DA is entitled to elect the Mayor and recall the Mayor. It follows she only intended resigning as Mayor.
Further she says an 'in context'- interpretation of her remarks show that it was a CONDITIONAL or hypothetical statement- *if* and only *if* she had been fairly subjected to due process, would she resign. She says that's PLAINLY what her words on The Eusebius McKaiser Show meant.
It follows that her words cannot be said to have been a straightforward assertion of an actual intention to resign, since it was a very qualified statement and at any rate only about the Mayoral position. Or so claims #DeLille
Argument 2: #DeLille argues that at any rate the clause used to rescind her membership is unlawful: it offends PAJA insofar as it gives too little time for responding; it offends the right to free expression; allows unfairly for unilateral rescinding of membership; etc.
#DeLille says the history of disagreement on the MAIN issues shows both that a) the recall clause and the b) invoking of membership termination clause malicious moves. She pleads with the court to find, on urgency, and convenience, to temporarily reinstate her membership.
#DeLille would then, should her DA membership be reinstated in the interim, proceed and/or continue to contest all the big pieces of the entire matter- Steenhuisen report; other reports and allegations etc.

It is now up to the DA to respond to these legal arguments.

#DeLille also argues in the legal papers that the @Our_DA in fact even offered that she becomes an MP if she gave up her Mayoral position & this is an indication that until now they themselves were not interested in rescinding her *party membership*. Until 7:52am today, suddenly.
