Hey @realDonaldTrump - have you asked Judge Kavanaugh what happens if Giuliani lies to Mueller for you? It wouldn’t be the first time he’s considered that question — and you might not like the answer.
We found this 1996 memo in the Kavanaugh files that the National Archives just released in response to our lawsuit with @FixTheCourt: documentcloud.org/documents/4630…
While working on the Starr commission, Kavanaugh asked whether a person can violate criminal obstruction of justice laws by lying to his attorney when the attorney is preparing for an official inquiry. Which seems relevant to @realDonaldTrump’s interests.
The memo to Kavanaugh said that while—as of 1996—there were no known court decisions dealing with that exact issue, it could be analogous to “misleading a witness, and intending that the witness will convey the misinformation to an official proceeding" documentcloud.org/documents/4630…
Remember: this was not a hypothetical question for Kavanaugh, who was working on the Starr commission investigating Bill Clinton.
