18 USC §1623 is lying under oath: to ANY fed—including Congress.
As in: “Secret memo, stolen from Democrats? Never saw it. Nope.”

Congress: “You SURE, Kavanaugh?”

K: “Sure! What even IS a memo?”

C: “Confirm this man as a federal judge!”

Reporters from the WaPo, Slate, & others, learned Kavanaugh received at least one email with a subject line:
“Judiciary Dems Obstruct on Reorganization”
& another marked “confidential info” from “Dem staffers”

Some try to argue Kavanaugh’s crystal-clear denials—in which he absolutely said he had NOT seen the info— were “technically” true...

... since an email is not a memo...and like David Lat points out, technicalities do matter... but so does “mens rea.”

“Mens rea” is a Latin term; it means “guilty mind.” Re: prosecution, it asks-> did this person MEAN this crime, or was it accidental? It’s an important Q. (FYI: some crimes, like statutory rape, discard mens rea, & use “strict liability.”) (8/10)
Prosecuting perjury can involve mens rea, as we saw w/Martha Stewart—but it can also involve potential other crimes a defendant might be charged with—& CAN be used as leverage to get a witness to flip... because the penalty for a 1st offense... (9/10)
....can be 12-24 months in PRISON AND up to $250K—which was almost as much as Brett Kavanaugh owed in baseball tickets, weirdly.

(I wonder if his GoFundMe would pay off THAT fine as quickly...?)
