DOJ is seeking to appeal a district court ruling from September that members of Congress have standing to sue Trump over allegations relating to the Foreign Emoluments Clause. Background on the September ruling, from @ZoeTillman: buzzfeednews.com/article/zoetil…
Because of the type of ruling, which was only on standing (whether are appropriate plaintiffs to bring the lawsuit in the first place), an appeal would normally not be allowed at this time. DOJ is asking for an order from the district court allowing it to appeal that ruling now.

BREAKING: Supreme Court denies the foreign country-owned company's request to stay a contempt order resulting from its refusal to comply with a grand jury's subpoena. Chief Justice Roberts' "administrative stay" is vacated, so the result is the contempt order is back in effect.
That order of the court follows this request, made Monday but put on the docket today, to file a cert petition in the case under seal. Not clear what will happen with that now, but the contempt order (and associated fines) will now be back in place.

It's a one-box Tuesday here at #SCOTUS, meaning one or two decisions in argued cases should be coming at 10a.
The first decision is Justice Kavanaugh's first majority opinion, in Henry Schein, Inc. v Archer & White Sales, Inc., vacating the 5th Circuit in an arbitration case. The decision was unanimous. #SCOTUS

2/ The court indirectly addressed the argument advanced by @SethBTillman and me. Rather than accepting Plaintiffs' position that Foreign Emoluments Clause applies to *all* federal officials, Judge Daniels said it applies to "certain" officials.
3/ Though I am perplexed by Footnote 2. Judge Daniels wrote "Defendant has conceded that he is subject to the Foreign Emoluments Clause." The government said the *exact* opposite "the government has not conceded that the President is subject to the FEC." DOJ should correct this.
