BREAKING: Supreme Court denies the foreign country-owned company's request to stay a contempt order resulting from its refusal to comply with a grand jury's subpoena. Chief Justice Roberts' "administrative stay" is vacated, so the result is the contempt order is back in effect.
That order of the court follows this request, made Monday but put on the docket today, to file a cert petition in the case under seal. Not clear what will happen with that now, but the contempt order (and associated fines) will now be back in place.
REDACTED DOCUMENT: Here's the redacted motion at SCOTUS, noted previously, of what appears to be the foreign-owned company seeking to file its petition for certiorari in the grand jury dispute under seal. documentcloud.org/documents/5677…
Interesting note: The lawyers actually sought to file it, apparently, on Jan. 3. It was, however, not accepted by the clerk's office until Monday, and not made public on the docket until today.
JUST IN: We also just got the DC Circuit's opinion affirming the contempt order in the mystery grand jury case. The news here is just what's in it, b/c recall that in December, the DC Cir issued the judgment and said an opinion would be forthcoming. documentcloud.org/documents/5677…
News: The fine against the company is to be a fine of $50,000 per day, per the DC Circuit opinion.
[And, yes, folks, I'm in the midst of writing up a story here detailing what all has happened today — as soon as I can get through all of it (and presuming new stuff stops coming in).]
I will admit to appreciating the selected non-redactions here.
News-ish: The DC Circuit opinion makes clear that that first procedural issue with this case, when the DC Circuit dismissed the appeal, was that the company sought to appeal the district court's denial of its motion to quash — before the company was held in contempt.
NEWS: The foreign-owned company in the grand jury subpoena dispute has at least one US office and was served the subpoena at that US office, DC Circuit's concurring opinion reveals, citing government letter and brief.
OK! Here's my report on what happened today with the mystery grand jury dispute —> The Supreme Court Says A Mystery Foreign-Owned Company Will Have To Pay Daily Fines buzzfeednews.com/article/chrisg…
