This story rocketed around the internet today. It is wrong.

Bevin’s lawyers argued that Davis acted on behalf of the county, not the state, and that the county should thus be obligated to pay attorneys’ fees. They did not argue that Davis herself should have to pay the fees.
Also, Bevin’s lawyers made this argument in a brief filed in May 2018. Yet it has been reported as though it is a new development.

How did this happen?

The @heraldleader misreported the information, then failed to link to the brief it misread. Other outlets, like @thehill, aggregated the initial report without checking its claims.

So, to review:

Bevin’s lawyers argue that Rowan County, not the state of Kentucky, must pay legal fees awarded to the attorneys of same-sex couples who sued Kim Davis.

No one argues that Davis herself must pay these fees.

This dispute emerged in May 2018, not this week.
Also, just for the sake of accuracy: Bevin’s lawyers first argue that attorneys for the the same-sex couples who sued Kim Davis do not deserve attorneys’ fees at all. Their backup argument is that if the court awards those fees, Rowan County should have to pay them.
