Sometimes it’s helpful to take a step back, for perspective. In March 2014, when I filed this action, my primary goal was “make sure that Marshall University never does this to anyone else.” I may have accomplished that goal. That would define success.
The Court already has 2 CRA cases it can decide, that lack (arguable) ripeness problem.
And much else took place in past 5 yrs. I’ve seen published policy changes at Marshall that (in part) address what I was unlawfully put through.

And a certain prominent, known bigot no longer appears on the faculty roster. That’s good news for Black and Jewish teaching credential candidates, as well as for LGBT candidates.
It’s still possible to journalistically-explore the long-time embedment of a Klan cell in Marshall University’s teaching program. And I may pursue that, in some way, given that I now won’t be litigating it to a jury.
There are also two attorneys who adopted a forged document, presented it to a federal court as true and authentic, and failed to withdraw it when pressed. I have explored whether bar punishment is merited for such offenses, and will likely pursue that also.
But I’ll never have the last five years restored to me. Nor will I ever be compensated. Those are the risks of litigation, and they’re increased when a certain state has a litigation culture of rank corruption. It was always an uphill battle. They’re worth fighting. Fight yours.
