The writers of the Constitution went to great lengths to ensure we had a president and not a king. You have to wonder what they’d think about the executive branch just making up a rule that the president can’t be charged for committing crimes.
The argument I usually hear for the rule is “imagine the process gets politicized and the president is indicted for petty reasons.” Okay, but imagine the president has committed a long list of serious crimes while in office. (It’s easy if you try.)
If you’re worried about politicization, it seems much more likely that the president’s DOJ wouldn’t charge when they should than vice versa. You’d probably need some sort of independent prosecutor for it to happen. Hypothetically.
