Opinions in some of the remaining 31 argued cases coming at 10a at #SCOTUS. It's a two-box day, per @Arianedevogue, so, likely 3 or 4 decisions coming today.
While we're waiting, here's Doug Berman (@SLandP) on today's criminal law #SCOTUS cert grant: sentencing.typepad.com/sentencing_law…
First #SCOTUS decision is in Azar v. Allina Health Services. A 7-1 decision by Gorsuch, affirming the DC Circuit in a case over required notice-and-comment, with Breyer dissenting and Kavanaugh not participating. supremecourt.gov/opinions/18pdf…
Second decision is in Taggart v. Lorenzen. A unanimous decision by Breyer, vacating and remanding to the Ninth Circuit. supremecourt.gov/opinions/18pdf…
Ginsburg has the unanimous opinion in Fort Bend County v. Davis, holding that Title VII's charge-filing requirement is not jurisdictional, affirming the 5th Circuit. supremecourt.gov/opinions/18pdf…
The final #SCOTUS decision today is Mont v. US. The 5-4 decision holds that a person's supervised-release time is tolled during a period when they are held on later charges if they are later convicted and that time is counted as time served. supremecourt.gov/opinions/18pdf…
Interesting #SCOTUS 5-4 lineup in Mont, with Ginsburg joining Thomas's majority opinion and Gorsuch joining Sotomayor's dissent.
