Ah—so it was both Trump and George W. Bush who asserted executive privilege over Kavanaugh’s documents when McGahn’s attorney, Bill Burck, was in charge of releasing them.
As Kavanaugh was a gatekeeper for Bush’s judicial nominees, he would’ve been in a prime position to know exactly how influential Philip Anschutz’s recommendation letter was when the decision was made to nominate Gorsuch for the Tenth Circuit.
But Bush gave Michelle Obama a piece of candy at his father’s funeral, so it’s easy to see how people were willing to forgive him for being complicit in the theft of a second Associate Justice seat.
