It’s insane, INSANE, how influential two bad memos are on the history unfolding before our eyes.
The whole conceit is that, while there isn’t any constitutional provision or statute that say so, the separation of powers *implies* that the sitting president is *too busy* to be held accountable to federal criminal law.
The memos are pure freshman dorm hallway theorizing, but they’ve somehow become more powerful than the whole edifice of actual constitutional provisions and laws because two OLC bureaucrats signed onto their reasoning.
