@CGrantWSJ @TESLAcharts 1/ here you go, Mr. Grant. Let's start with the "workplace violence" TRO application, filed April 19, 2019:
@CGrantWSJ @TESLAcharts 2/ Let's proceed to the contents of the TRO:
@CGrantWSJ @TESLAcharts 3/ Got that, sir? "suffered actual and threatened violence." Violence! Here's a bit more:
@CGrantWSJ @TESLAcharts 4/ Oh, my! Well, let's take a look at the evidence. We'll start with the Declaration of one Christine Leslie.
@CGrantWSJ @TESLAcharts 5/ What's that you say, Christine? You conducted an "investigation"? But you weren't even anywhere nearby for either incident? Don't lawyers have a word for that? Ah, yes. Hearsay. Completely inadmissible.
@CGrantWSJ @TESLAcharts 6/ Okay, then, let's see what the witnesses have to say. Let's start with Tyler James.
@CGrantWSJ @TESLAcharts 7/ He struck you, Tyler! Oddly enough, police reports have a very different account of what happened. As you know, Tyler, $TSLA begged the police to refer the case to the prosecutors as hit-and-run. But, after viewing the security video, they said, NOPE. Not even for you, Elon.
@CGrantWSJ @TESLAcharts 8/ Thank goodness for those $TSLA security cameras. That should be enough to hang this miserable raghead, Randeep Hothi. All you need to do is show the Judge the video, right Tyler? Right, Elon?
@CGrantWSJ @TESLAcharts 9/ And, of course, then there is the triggering incident on April 16, when Hothi followed the Model 3. Oh, what a reckless and dangerous man he was! Let's here from Matt Cross, "Senior Content Producer for Tesla, Inc."
@CGrantWSJ @TESLAcharts 10/ Finally! We have this dangerous homicidal maniac dead to rights! We had 2 cameras mounted on the roof. Another mounted inside the car (with audio track, so you can hear our terror). And 8 cameras integrated into our Model 3 (FSD!). And we all had our cellphone cameras.
@CGrantWSJ @TESLAcharts 11/ So, all we need to do is produce all these recordings, right? Well, wouldn't you know it, that's exactly what that homicidal raghead's lawyer asked us to do. Oops! Time to get on the horn to our lawyers!
@CGrantWSJ @TESLAcharts 12/ Here, this should settle matters:
@CGrantWSJ @TESLAcharts 13/ But, uh oh, this Judge? Why isn't he more like Alison Nathan? Why isn't he more like Jon Clayton? Look what he did on July 1!
@CGrantWSJ @TESLAcharts 14/ Time for new $TSLA lawyers! And a new motion!
@CGrantWSJ @TESLAcharts 14/ Being the smart, new $TSLA lawyers on the scene, let's start by pretending there are only three recordings:
@CGrantWSJ @TESLAcharts 15/ (oops, that last one is now 14A, okay?)
@CGrantWSJ @TESLAcharts 16/ So, you got that, right? Whatever you do, no audio of those guys talking in the car. What if, for instance, they're saying, "Damn! We almost swerved into that median!" Or, "FSD, hah, what joke! Can't believe $TSLA gets people to pay for it!" Or, "Wow, that Elon, what a jerk!"
@CGrantWSJ @TESLAcharts 17/ Except, there are a few problems there, no? The raghead's lawyers pointed them out. To start with, What do you mean, just 3 cameras?
@CGrantWSJ @TESLAcharts 18/ And, what about those guys with cellphone cameras in the Model 3?
@CGrantWSJ @TESLAcharts 19/ And, what the heck do you mean, no audio track? Weren't those guys in the Model 3 fearful for their lives? Let's hear it!
@CGrantWSJ @TESLAcharts 20/ Ah, yes, the personal & private stuff, and the stupendous $TSLA trade secrets. No worries, Elon, the homicidal maniac raghead doesn't want any of that:
@CGrantWSJ @TESLAcharts 21/ More letter briefs, with truly stupid things said by $TSLA's new counsel, but let's skip that and get to the July 28 ruling. First, as regards the video recordings:
@CGrantWSJ @TESLAcharts 22/ Ah, yes, those 8 integrated cameras transmitting all that data to Fremont for those geniuses we saw on Autonomy Day to analyze "corner cases". Let's see it, $TSLA. And, no worries, if it's really trade secrets, I, the Hon. Jeffrey Brand, will not permit anyone else to see it.
@CGrantWSJ @TESLAcharts 23/ Cell phone recordings: same deal. Turn it over, $TSLA, and if it's really private or confidential, I won't let anyone else see it.
@CGrantWSJ @TESLAcharts 24/ And the audio inside the car you so badly want to prevent anyone from hearing? Well, again, I promise you. No one will hear it. If, but only if, it contains the purely personal or actually proprietary information you allege:
@CGrantWSJ @TESLAcharts 25/ Let's sum up: $TSLA thought it could smear Hothi, destroy his reputation with allegations of workplace violence, have its flying monkeys descend with allegations he is a homicidal maniac, and have them urge his university to suspend him from his graduate studies....
@CGrantWSJ @TESLAcharts 26/ ... and $TSLA thought it could accomplish all that with accusations made in judicial pleadings which, as Tesla knows, are subject to a "judicial privilege" and cannot constitute the basis for a defamation lawsuit.
@CGrantWSJ @TESLAcharts 27/ And, further, $TSLA thought it was safe to do all this in a California "workplace violence" TRO proceeding, where it could file its suit with absolutely no notice to Randeep Hothi, and get its TRO before he ever knew what had happened (even though it knew how to contact him).
@CGrantWSJ @TESLAcharts 28/ So, $TSLA located some compliant, ethically lax attorneys to do the dirty:
@CGrantWSJ @TESLAcharts 29/ Discovery is typically not permitted in workplace violence injunction hearings because of the short timetables, so $TSLA thought it would be able to hide all the relevant evidence. But that didn't quite work out.
@CGrantWSJ @TESLAcharts 30/ So, $TSLA found some more compliant legal counsel with lax ethical standards who would make nonsense assertions, and tried to gum up the works with more motions and delays:
@CGrantWSJ @TESLAcharts 31/ But that didn't work out either. The Court stuck to its discovery order. However, it went out of its way to protect $TSLA's interests. Please read carefully from yesterday's order:
@CGrantWSJ @TESLAcharts 32/ There's more. Sorry, $TSLA, but it's called the First Amendment:
@CGrantWSJ @TESLAcharts 33/ Uh, oh. The jig is up. What to do? I have an idea! How about we stall on discovery...
@CGrantWSJ @TESLAcharts 34/ ... while planting a story with one of our reliable propaganda outlets!
@CGrantWSJ @TESLAcharts 35/ Ah! That felt so good! We smeared raghead yet again! Thank you, flying monkeys! I, Elon Musk, truly appreciate you! <fin> (or, actually, maybe not quite <fin>. TBD)
@CGrantWSJ @TESLAcharts 36/ Oh, wait! This just in! A letter:
@CGrantWSJ @TESLAcharts 37/ (continued):
@CGrantWSJ @TESLAcharts 38/ Not sure I share the faith.
