I wish I could say I was shocked by the SCOTUS 5-4 ruling lifting the 9th Circuit's injunction on using military funds to build the border wall. But given how deferential these 5 justices have been on questions of executive power, the ruling isn't a huge surprise. 1/6
The brief order hints at the 5 justices' rationale: not that the president's actions are legal, but that the plaintiffs have no legal right to challenge them. In other words, it's none of their business if the president flouts Congress's will -- even if it harms them. 2/6
It's just a preliminary ruling, so there's still a chance for the plaintiffs to convince the courts that they have a right to sue. But obviously, it doesn't bode well. 3/6
This makes it all the more important for Congress to pass meaningful reform of the National Emergencies Act. If SCOTUS isn't going to let courts serve as a check, then Congress must have the ability to act quickly and decisively to shut down executive abuse. 4/6
The Senate Homeland Security committee passed a bill this week (the ARTICLE ONE Act) that would automatically terminate emergency declarations after 30 days if not approved by Congress. That's exactly the reform we need. 5/6
It's crucial that the full Senate pass the bill, and that the House take up this or similar legislation ASAP, if we are going to shut down the president's abuse of power and prevent further abuses in the future. 6/6
