Instead of 5-6 days, it’s been 159 days since a special petition was filed against #Karnataka HC ruling upholding govt hijab ban in state educational institutions. “It just shows #SupremeCourt is reluctant to hear the matter:” Fauzia Shakil, case lawyer. 2/11

1. KS text is now THE #constitution of #Tunisia. The electoral body, #ISIE, just announce the referendum results: a 27% turnout and 94% of them approving the proposed text. A few takeaways:
2. Does this mean that almost 75% of Tunisians oppose(d) this constitution? Does it change the fact that this constitution is the culmination of an authoritarian, unilaterally, and unconstitutionally conducted process? In my humble view, the response to both is NO.
3. While 27% turnout is very low from a comparative perspective, note that the last Algerian referendum, in 2020, saw only a 23,84% turnout. A major French constitutional reform enjoying the consensus of almost all political parties registered only 30% turnout in 2000.

When cases have no legal basis, police make new allegations, based on unknown/untraceable complainants, file new cases with little/no evidence.@ManiChander11 identifies techniques union & state govts use to keep India’s ‘inconvenient citizens’ in jail. 1/7…
Activist Javed Mohd made calls for peace on 10 June, arrested as ‘mastermind’ of ‘conspiracy’ leading to violent protests in Prayagraj, UP, on 11 June. Within 24 hrs on a Sunday, 20+ yr old home where he lived (but didn’t own) was demolished as ‘illegal’.

Mohd #Zubair charged with ‘conspiracy’ but police can’t identify co-conspirator; fabricating evidence by deleting tweets but none deleted; accepting foreign donations, but no such donation made. Charges keep changing & an FIR allegedly registered against cash reward.

THREAD: Why is Indian #Constitution only for Religions & not Dharmas?

#Religion is not #dharma
#Temple is not #Mandir
#Prayer & #Worship is not #Pooja
#God is not #Bhagwaan
#Idol is not #Murti

This is exactly why #Places of Worship Act is totally WRONG

(1/18) @Aryan_warlord
You are not Swa+tantra = Self Governance, if native population is not represented in the document.

Several Indian dharmic non-translatables are dumbed down to Abrahamic streamlining by interpretation in the ill-equipped English language.

(2/18) @mnshdnth @kpl_kar @ShefVaidya
Elected Govt has to dance to the tunes of Vote bundles.
Judiciary can adhere max to what's written in the Constitution.
Guess what? It has no space for 4 Indian Dharmas. It is made for Religions of Foreign Origin.

On 26th Jan 1950, just two and half years after India achieved independence, the Indian Constitution took effect. India became a republic after national leaders spent 165 days debating topics ranging from a Uniform Civil Code to federalism.
1/10 Image
These discussions took place against the backdrop of events such as the tragic Partition of India, the beginning of the Kashmir conflict, Mahatma Gandhi's assassination and the merging of 300 princely states into the Indian union.

On 9th Dec 1946, the Constituent Assembly met for the first time and began framing a #Constitution, where all power and authority would be derived from people from all strata of society and different regions of the country.

Events continue to demonstrate, the weakness of the British #Constitution. Along with our fascination & or glee at Johnson's bunker stand-off in @10DowningStreet this is a lesson in hubris. There's no British exception to the need to have a formal system of checks & balances. /1
As the period from calling for the Brexit Referendum to now has demonstrated, bad chaps exist & have used the UK systems to subvert democracy & enrich themselves. The UK has to rebuild defences against kleptocracy. There can be no more business as usual. Only systemic change /2
Will remove the pitfalls exposed & played by the Vote Leave cabal. From advisory referendums played out as holy mandates, to Henry VIII powers ramming through change without Parliamentary scrutiny. We must learn these lessons or our democracy will die under the weight of greed /3

1/7 Recently published consultative committee's draft sheds new light on president KS draft #constitution 4 #Tunisia. Discrepancies btw both show that problematic provisions are conscious choices. Below table shows revealing differences btw committee's text & president's draft
2/7 The Chair and a member of the committee that developed the initial draft distanced themselves from President's proposed text. Cf. Text of their draft, letter by the chair, Pr.Belaid, & Pr. Amin Mahfoudh: &
3/7 One point attracted activists' and commentators’ attention: the constitution entering into force following the referendum, i.e. implicitly, regardless of the result. Understandable concern esp. when we compare this wording with the one proposed by the Consult. Com.

1. #Tunisia draft #constitution by Kaiss Saied’s is out. Below are initial remarks on the content of this text in particular on the political system, preamble, rights and liberties, and a few institutional design aspects:
The polit syst is a ‘presidentialist’ one following the tradition of post-independnce authoritarian Arab & African constit. It rests on 1 central, the president, around which a multitude of bodies gravitate while being, one way or the other, submitted to it
3. A bicameral and weakened parliament: A new chamber represents regions and provinces. Not clear from the text whether the law-making chamber is elected directly or not! One needs to wait for the electoral law.

#Karakalpakstan events concerning on several levels: 1) illustrates how LACK OF CONSULTATION in the proposed re-write of #Uzbekistan's #Constitution can backfire in various, unpredictable ways, such as setting off fears/concerns among Karakalpaks about a loss of autonomy (cont'd)
2) reports of internet outages/flight blackouts in/out of Karakalpakstan point to heavy-handed tactics out of step with #Uzb's international human rights obligations; 3) authorities must employ transparency in any detentions of protesters & avoid any disproportionate responses.
The statement of the independent #Uzb media outlet in #hookreport illustrates the INCREDIBLY sensitive territory anyone is wading into commenting on this situation. Statement makes the following points: (contd)

As an Irish citizen of a Constitutional Republic - I am yet again appalled this morning by what I witnessed this Government do to the #Oireachtas in the making of #legislation - facilitated today by @smytho a Minister of State in #DECC from @greenparty_ie - details below👇
On 14 June in 2nd stage debate on a bill on #CircularEconomy & #Mining the Minister flagged in less than 6 lines of words - a major scope change to the bill for "essential amendments on Committee Stage in this House to address some urgent matters concerning energy capacity" BUT👇
17 days later the Government:
😡Had not briefed even informally the JOC HLGH responsible for Planning or the JOC Env & Climate Action responsible for the EPA on the changes
😡Had not ensured a copy of the amendments was on the Oireachtas website for today's debate on them

On this day in 1975, Indira Gandhi proclaimed #Emergency.
Fundamental Rights were suspended.
Civil Liberties were scrapped.
Opposition was put behind bars.
Press censorship was imposed.
Democracy was wounded.
We lived in fear of the midnight knock. n1
As darkness descended at noon and freedom was shackled by the #Emergency regime, repression became the norm. Nehru Dynasty seized the nation and the Constitution was rendered meaningless. Government and Judiciary became putty in Indira Gandhi's hands.
One of the defining slogans of Indira Gandhi's #Emergency was:
“India is Indira; Indira is India.”
And backing Indira Gandhi were the Communists.

1] Seems like debates over the structuring of CCC, just won't go away.

At face value, these conversations are political manure, that will certainly help grow our democracy.

Politically also, these conversations reinforces the position of CCC as the ultimate alternative.
2] Writing an article attached below, I did opinion that it would be naivety of the highest order, for CCC to behave, and for its supporters to equally demand that it behaves, as if Zimbabwe is a normal democracy.

Doing so, will only lead to its demise .…
3] #PoliticalIdeology

I always laugh when I read that CCC has no political #Ideology.

By definition, an #ideology is a set #ideas; #beliefs; #values; and #opinions, providing #actionplans, for #public #policy making.

These spell out the party's overal #political #action.

As the dust settles on the civilian coup here are a few key takeaways: 1) #IK has lost morally and politically. the #Opposition wanted the #selectedPM out and new elections, and this will happen. #IK dragged his feet but eventually this has been the result. 1/n
2) Beyond politics, #IK has now clearly undermined the #Constitution, the Supreme National Institution. Article 95 is a self contained provision, which gives the #Speaker no power once leave has been granted for #VoNC. A vote has to be done, no matter what. 2/n
3) Article 69 is about matters of procedure in Legislature and doesn't apply if the Speaker decides to throw out the Constitution itself. Imagine if the Speaker decides to not count the votes of Women or non-Muslim MNAs? Would that be allowed by the SC. 3/n

I want to start out by saying, you folks are in a tough position, being PUBLIC SERVANTS of WE the People. I would like to believe that you truly have the best interest of our children and the community in mind, but you are factually acting outside of your delegated authority...
by practicing medicine, imposing unlawful medical interventions, and by simulating legal process.
That being said, our forefathers put together one of the most powerful and amazing documents in our history. The #constitution, which was drafted to protect individual rights!
They did this in an effort to make sure we didn’t end up under #tyranny again, and yet, here we are with individuals and Agencies operating outside of both their delegated authority and outside of the law. I’d bet my LIFE (emphasis added), if any one of them were alive today...
