11. Aug 3 Update: I think I may know what's going to happen. Mueller's FBI counterintelligence observers were keeping him walled from the ongoing CI investigation so that the material Mueller saw was all well within constitutional requirements for admissibility. That makes sense.
12. Though the facts have been clear, I didn't really comprehend that Mueller's investigation was a brief interlude in a much larger investigation. And I don't know if any of the material the CI team is gathering would be admissible in court because it's all FISA probable cause.

14. I think this is the key. When Gates first penned his Procedures they dealt with FISA intercepts where a member of Congress is subject to "incidental collection." FISA requires "minimization procedures" for all US persons who are subject to such incidental collection
15. via identity masking. But what just occurred to me is that the members of Congress who have been involved in the Trump Russian CI investigation are very likely to not have been subject to incidental collection but rather were alleged to be agents of a foreign power regarding

17. they are agents of a foreign power and thus lawful traditional FISA Title 1 warrant targets. But now that they have the proof they can't use it in court. But they could use it to force a load of GOP members of Congress to resign or have it disclosed publicly.
18. So, if I am right, and @POTUS wants to keep the entire scheme from being dropped before Coats departs, he has to appoint Sue Gordon or I think the whole deal will drop taking down a lot of people in Congress. Might be a good time to not mess with the Principal Deputy. 😎
