Just in: House Judiciary Comm. lost its bid to have its subpoena lawsuit against Don McGahn assigned to the same judge handling Dems' petition to unseal Mueller grand jury info — judge found the connection between the cases "too superficial and attenuated" assets.documentcloud.org/documents/6270…
Chief Judge Beryl Howell: "The potential for manipulation of the ordinary rule of random assignment would be particularly acute if the House Judiciary Committee could relate any matter arising from its ongoing investigation to a single judge on this Court..."
This means that the Don McGahn subpoena case will go back to the wheel for random assignment to another judge
Update: The Don McGahn subpoena fight has now been randomly assigned to US District Judge Ketanji Brown Jackson

Paul Manafort filed a motion yesterday to dismiss the financial crimes charges filed against him in state court in NY. As expected, he's arguing they should be tossed on double jeopardy grounds, citing overlap with his bank fraud conviction in EDVA assets.documentcloud.org/documents/6382…
Something notable: As much as the early rounds of litigation in Manafort's federal cases were about challenging the special counsel probe and Mueller's authority, that's a non-factor here — instead, in Manafort's motion we get several jabs at NY DA Cy Vance
From Manafort's motion: "Mr. Manafort is entitled to the equal protection of New York’s double jeopardy statute, which permits no exceptions for defendants who have garnered national interest, nor for favored political causes of the elected district attorney."

That said, court action could change dynamic. Schiff and Cummings both told me today that they could back impeachment probe if Trump defies a court order. And several Dems believe that Pelosi’s tone after Mueller hearing shifted to suggest she could be open to moving ahead
Schiff on impeachment. “Certainly when we get to the point in litigation where the Trump Administration can no longer appeal, should they refuse to abide by a lawful court order, we may really be in a constitutional crisis. And that would be enough for me."

#Mueller failed to identify the grand jury info in the #MuellerReport. Barr noted that “it immediately meant that you know it was going to be a period of weeks before we could get the report out.”
2) Who actually wrote Volume I and Volume II of the #MuellerReport?

At this point, it isn’t known with certainty if #Mueller had any hand in writing the report directly, or if he simply served in an oversight capacity.
