Very important point here on the effect of prorogation combined with a 31/10 exit date. Together, they remove Parliament’s ability properly to scrutinise the tsunami of Statutory Instruments needed to make our statute book ready for a crash out Brexit. ukconstitutionallaw.org/2019/09/04/ale…
As the article explained, the tsunami is made larger and more serious because there is now no way *any* of the primary legislation the Government said was necessary to pass by Brexit can now get through. See also lawgazette.co.uk/commentary-and…
Prorogation plus the insistence on the 31/10 exit date makes it impossible to get our law book in any state for a crash out Brexit. The consequences and costs of that for businesses and individuals will be enormous and unpredictable. This is bad government. (H/t Lorenzetti)
Further, the Government’s approach - including its insistence that the legislation needed to implement any deal should be rushed through in hours in late October - is antithetical to any notion of proper Parliamentary scrutiny.
Parliamentary scrutiny matters to our democracy, to the legitimacy of our law, and to correct errors and unforeseen effects.
The position of politicians now in high office, who used to insist on line by line scrutiny of every tittle of EU related legislation, but who now propose the steamrolling of Parliament in order to meet an arbitrary deadline, can only be described as grossly hypocritical.
