In short, they are subject to freedom of information requests, if they were generated in the course of the official’s conduct of the business of the authority. That would apply to communications between one Spad and another about what decision should be taken and why.
That is obvious when you think about it: the alternative would be to drive a coach and horses through the Freedom of Information Act.
Cummings should know about this, as part of the background was @michaelgove’s use of a private e-mail account for government business while he was Education Secretary.
