Information Commissioner's Office makes clear that 'pre-ticked' boxes for consent to things are not OK as you need "clear and specific" consent to sign up for things.

But since the Times' first para requires no action to receive promotional material, it is "default consent" 2/3
Perhaps Times web people thought they were being clever by default being *no tick* rather than *a tick* but since outcome is a form of default consent (do nothing and you are signing up anyway) and it is also confusing cos of second box, it is dodgy 3/3 ico.org.uk/media/for-orga…
