When the text of the brexit deal arrives later today, no need to treat as a tablet of stone. Just a reminder that Boris Johnson has had a lot of brexit ideas before today that he's had to junk, so precedent would suggest things are less sacrosanct that No10 will claim
Initially No10 said they would not talk to EU leaders until they had agreed to junk the backstop. That fell by the wayside.

Then they said they weren't going to propose legally operable proposals - that would be negotiated in the implementation period. That's gone.
Last weekend brexit secretary Steve Barclay was still saying the plan was simply to drop the backstop. That's not what's coming today.

There is some scepticism around Whitehall that brexit negotiator David Frost is managing the process particularly well. We shall see.

Timeline indicates that it is the Night Before Christmas for all of UK legal Twitter

Genuine, tense excitement, with nobody certain, though some pretending to be confident

Everyone eagerly speculating as to what will be in the Supreme Court stocking at 10.30 tomorrow morning
And it is exciting

Legally, one can see it go either way

But deep down, any liberal constitutionalist wants Supreme Court not to bottle it

The court should assert the rule of law and the separation of powers, against arbitrary government

But scarily worrying they will not
Either way, it is extraordinary and wonderful for there to be such attention focused on our Supreme Court for a fundamental constitutional question

But let's not make a habit of it

Constitutional law should be dull, not exciting

Wolffe's case is that judicial review operates on a "sliding scale" with greater intensity when constitutional principles are at stake. The court must give it a "rigorous and searching review."

Judge Carnwath says he's a critic of concept of sliding scales.
The government's case is separation of powers between court and parliament.

Wollfe says separation of powers is "predicated on accountability of government to parliament". Court must grip what happens if this is removed.

1. On July 17, the House Judiciary Committee held a 3-hour hearing to examine the content filtering practices of social media companies. Executives from Facebook, YouTube, and Twitter were invited to provide testimony and answer questions from the committee.
2. Over 210 million Americans use social media. Even the Supreme Court called it a Constitutional right. Thus, it's staggering that only a few executives in Silicon Valley decide what 2/3 of America is allowed to talk about. This a growing concern to Congress.
3. So who are the employees at these companies controlling what America is allowed to say? Nobody knows.

What is the process for censoring or banning? Nobody knows.

What training materials do they use? Nobody knows.

Are they men, black, religious, American, etc? Nobody knows.
