Just in: DC federal judge found DOJ wrongly redacted the names of witnesses who did *not* testify before the Mueller grand jury in a doc filed in court. So that info must be made public — judge notes two people "figured in key events" in Mueller's report ecf.dcd.uscourts.gov/cgi-bin/show_p…
It just occured to me that referring to people who did *not* testify before the Mueller grand jury as "witnesses" might be confusing/imprecise, apologies for that. These people were potential grand jury witnesses, we don't know anything else about them yet
Here's the redacted version of the DOJ declaration at issue: assets.documentcloud.org/documents/6491…

The judge ordered DOJ to file a version with parts of paragraph 4 unsealed, which identify two people who didn't go before the grand jury but "figured in key events in the Mueller report"

NOW: A federal appeals court will not block a grand jury subpoena for Trump's tax returns, rejecting Trump's argument that any "presidential immunity" that might shield him from criminal prosecution means he can't ever be investigated while in office.

Hello from the DC federal courthouse, where Roger Stone has a pretrial conference this morning. Jury selection is set to begin tomorrow.

Stone's pretrial conf. is underway. Judge Amy Berman Jackson is going over the trial schedule:
- She expects to finish jury selection tomorrow
- If they finish tomorrow, no opening args until Wed.
- If jury selection goes to Wed., they'll start with openings as soon as seated
The judge warns everyone that live audio/video will be piped into the media room (hello from the media room!) and to be wary of what the microphones in the courtroom can pick up even when no one is up at the lectern

JUST IN: Judge Howell says DOJ improperly redacted a recent filing to prohibit the House from learning the identities of two witnesses who *didn't* testify to the grand jury.

She also adds this curious bit questioning why Mueller didn't seek to subpoena these unnamed witnesses.
Howell also notes that DOJ's claim -- that revealing the identities of people who didn't testify to the grand jury would help the House identify who did -- omits the fact that DOJ willingly revealed that they considered but did not subpoena Trump.

Thread: It’s time to discuss SCOTUS

Since April, House Dems have been fighting in court to get documents and witness testimony related to their impeachment inquiry. Those court cases—and NY’s criminal case—are on a collision course with SCOTUS.

Let’s take a look at the issues.
Preliminary Note 1: House Dems do not technically need more evidence to impeach Trump. They have all they need to impeach him now for disloyalty in asking Ukraine for election interference. But House Dems want an ironclad case and, for that, they need more evidence from SCOTUS.
Preliminary Note 2: Trump has only appointed two of nine SCOTUS Justices. In many cases, Trump has no plausible legal argument and no real hope of victory. In those cases, his only goal is/was delay. Trump’s legal team knows they will lose those cases at SCOTUS.

1. Note the date: the confidential files with evidence were leaked in October 2018.
2. The Twitter account has been removed. It's old news. There is nothing discrediting to Mueller's investigation in the fact that the Russians stole the files. If anything, it confirms that, yes, Russians hack.
