The Judge doesn't seem to look too kindly on what JY did with the court's resources:
After questioning JY on which specific genitals were in play in this case, the Judge stopped short of ordering a physical examination "on the basis that it was unduly intrusive and disproportionate to the issues at stake."
This is a fascinating bit, which underscores the gender/sex clusterf*ck we're enmeshed within.
Here's where the decision shows how dangerous the Tribunal is—how easy it is to abuse—when bad faith needs to be held to an "objective standard"—but where is the "objective standard" for "a climate of understanding and mutual respect"—ie the objective standard for disrespect?
Question: how does Canada's "commitment to multiculturalism" square up against cultures who define male and female differently than Canada's government? Is not multiculturalism itself a culture that, once given legal authority, will deem itself the sole—or highest—culture?
There are deep questions here: is the transgender issue settled—or have ruling bodies decided to settle it for us? How is a culture of understanding enforced—and what happens to regular old human misunderstanding in such an environment? Can people be fined into enlightenment?
It is apparent that, in this decision, "objective standards" are themselves subjectively relied upon. Though it rules against JY's behavior, it gives this behavior the longest possible shadow of doubt, and the shortest shadow to identity based discrimination.
Case in point: one of the biggest influxes of public attention and condemnation came through @MsBlaireWhite's interview with JY, back in early August. Both of whom identify as transgender women. And only one of whom engendered public vitriol.
