PRESUMPTION OF INNOCENCE
A system that is prevalent in the Commonwealth Nations where a defendant who enters trial is presumed to be innocent of the crime. 1) #presumptionofinnocence
However, this presumption only holds until the defendant is proven to be guilty of the crime during investigation. 2)
The presecutor assumes the responsibility of proving the defendant guilty in court. The defendant however has no obligation to prove his innocence unless in retaliation to an evidence presented in court. 3)

Spain's Foreign Ministry has been sending a 70-page dossier about Catalonia to journalists.

It's ideologically-charged and somewhat incoherent.

But it also appears to violate the presumption of innocence of imprisoned Catalan representatives, which is very serious.

The document, falling perfectly in line with the prosecution, declares that the statement "the independence movement is peaceful" is "fake".

It goes on to suggest that pro-independence protests held in September 2017 (in which nobody was injured) were actually a "seige".
The word "tumultuous" is rarely used in Spanish.

But in a blatant reference to the crime of "sedition" (a "tumultuous uprising" in the Penal Code), the Spanish-language version of the dossier repeatedly uses "tumltuous" to describe events.

It is meant to suggest criminal guilt.

In an interview today in @welt, Spanish Foreign Minister Josep Borrell said that imprisoned Catalan leaders "deliberately violated the law".

This clearly violates the presumption of innocence.
And @EU_Commission rules.

Sadly, this is part of a pattern in Spain.

Catalan leaders have spent as much as 1.5 years in pre-trial imprisonment. During this time, multiple public officials have said that they "committed crimes".

The statements published today from Foreign Minister Borrell are the norm, not the exception:
