While Parliament is prorogued, neither House can meet, debate and pass legislation. Neither House can debate Government policy. Nor may members of either House ask written or oral questions of Ministers. They may not meet and take evidence in committees.
The Courts held in 1611, that an attempt to alter the law of the land by the use of the Crown’s prerogative powers was unlawful. “The King hath no prerogative, but that which the law of the land allows him”, ie the limits of prerogative powers were determined by courts.
Laws enacted by the crown in Parliament are the supreme form of law, with which everyone, including the Government, must comply. Time and again, since the 17th century, the courts have protected Parliamentary sovereignty from threats posed to it by the use of prerogative powers

Over the last few days people have been asking me not to criticise Boris - arguing that his politics are harmless. This is his first interview. I’m afraid to say these threats on the 39 Billion are undignified. And the threats on the Irish Border are irresponsible...
He is promising to get no-deal through parliament - a promise he cannot keep. And he has no clear view of what tariffs he seeks, or which British business he is seeking to protect. Where is the consistency, clarity, strategy or values in any of this?
Some countries now favour this type of politics. But polls suggest the public doesn’t want this type of politics in a Conservative prime minister. And if the MPs allow me the opportunity to debate Boris in the final 2 I think we will find the members don’t want this either.

Principles on Brexit. And a challenge to all other candidates:
1. Will you take No-deal of the table? Completely. It won’t get through the commons. It is a recipe for furtheir delay and uncertainty.
It will undermine 300 years of reputation for economic competence. And in particular the conservative party’s reputation for economic competence. And it is, therefore not a credible threat.
2. Will you stop pretending that you are going to be able to negotiate some alternative deal with Europe? Completely. There is literally no evidence at all that Europe will give us a different deal.
