SOLICITING FOREIGN CAMPAIGN CONTRIBUTION (52 U.S.C. §§ 30109, 30121)—The FECA prohibits foreign nationals from making contributions or donations. It is a felony punishable by up to five years’ imprisonment if the amount exceeds $25,000.
COERCION OF POLITICAL ACTIVITY (18 U.S.C. § 610)—Federal officers are prohibited from engaging in political activity. If you cause someone else to commit a criminal offense, you can be charged for that crime as if you carried it out yourself.
MISAPPROPRIATION OF FEDERAL FUNDS (18 U.S.C. § 641)—It is a felony to knowingly take for one’s own use property that belongs to the federal government (like money allocated for foreign aid). Offenders can be fined, imprisoned for up to 10 years in prison, or both.
OBSTRUCTION OF CONGRESS (18 U.S.C. §§ 1505, 1512)—It is a crime to impede a congressional inquiry. It is another crime punishable by up to twenty years imprisonment to knowingly intimidate or threaten or corruptly persuade a congressional witness.
It’s not just a question of high crimes and misdemeanors. President Trump committed ordinary crimes for which ordinary Americans could be prosecuted and punished.
