Here's the order issued by the FISA court today. I've highlighted some important parts. One page 1 the Court points out that warrants on US persons must not be based on activities protected by the 1st Amendment (meaning basically that some non-legal action must be involved.) /1
On page 2 the Court points out that its earlier cases/orders had made clear that FBI/DOJ have a "heightened duty of candor" to the Court because of the "ex parte" (secret & one-sided) nature of the Court. /2
On page 2 the Court also points to the part of the statute which says the FISC is reliant on the agency requesting the warrant for info. This is what I've been saying: they are 100% dependent on DOJ/FBI. /3
On pages 3 and 4, the Court orders FBI/DOJ to tell it what it has or will do to ensure that statements in FISA warrant applications reflect accurately & completely the info FBI has "material to any issue presented by the application." /4
On pages 3&4 the Court also says it ordered FBI on Dec 5 to give it info on other warrants that may have been touched by the FBI lawyer who doctored an email in Page's case & that it intends to release the Dec 5th order after giving DOJ time to work on any redactions needed. /5
