Plagiarism thread. Okay, so you can see that the problem is not simply a failure to properly cite, I've excerpted & highlighted the portions of the text from the Flynn motion & the Amicus Brief. Sullivan's decision 👇🏻says exactly what pages to look at for comparison. /1

None of the quoted language is identified as quoted, even though it is verbatim the same or 99% the same in some places. That is what plagiarism is. This is not simply a failure of proper citation. I'm not saying Sidney Powell did this on purpose or meant to mislead the court./6
But it doesn't have to be intentional to be plagiarism. This kind of problem normally arises when you have different people contributing to a paper & no one person is reading everything. So it goes unnoticed that someone drafting has failed to properly indicate quoted language./7
It's important for junior lawyers to learn that it is necessary to both cite AND attribute. Citing is giving the case name/number, etc. for authority. Attributing is showing where you are quoting someone else- even if they are already citing or quoting the cases they're using./8
And it's necessary for senior lawyers to recognize when draft language that is prepared for them to review is not the in voice of the person preparing drafts and therefore may come from a source that hasn't been quoted. /9
