Mike Flynn's lawyers filed motions today to withdraw his guilty plea, citing what they say were conflicts with his prior counsel; and to dismiss the case altogether for "outrageous government misconduct." These are both high hills to climb.
The motion to dismiss is something. It argues the charges against him should be thrown out partly because the FBI tricked him into talking to them and didn't warn him that he was under investigation, and that somehow this induced him to lie (which it also says he didn't do).
The motion argues that the IG found wrongdoing by an FBI agent, and that DOJ was required to disclose this. It doesn't cite the Supreme Court ruling expressly holding that there is no right to this type of impeaching evidence before a defendant enters a guilty plea.
Flynn's lawyers say the fact that an FBI official surreptitiously attended a national security briefing for Flynn and Trump in 2016 requires that a court dismiss the charge that he lied to the FBI in 2017.
