People are asking why the EU is asking the government to sign up to level playing field clauses to get zero tariff. The thing is...this was entirely expected and I wrote about it in November.

It's a great thing for those who voted to leave. Let me explain...
When Jacob Rees-Mogg was asked what the first things he would change when we left the EU, what did he answer?

And Neonicotinoids

There are people tipping Jacob to be a future Conservative leader...
Neonicotinoids are insecticides, and are designed to kill insects. The question, which is heavily disputed, is if they can be safely used on crop. The EU is concerned.

Australia and New Zealand continued to use them, but they aren't happy either.

Boris Johnson may say standards won't drop now, but the EU have no reason to believe he will keep his word, and in the phenomenally unlikely even he doesn't break his word, they have no reason to believe a future PM won't keep Boris' word either.
Added to the fact there is an old political saying:

If you vote a compulsive liar into office, don't be surprised if they are ineffective on the world stage.

The people of the UK democratically chose to field a bad player for the job. His standards now speak for our country.
The fact Boris has got a history of dishonesty, means that the level playing field provisions really support the democratic will of the people.
During the referendum we were told that standards wouldn't go down and were more likely to go up.

Great!

The problem is the UK people who voted for Brexit couldn't make the politicians sign on the dotted line to say they would deliver on that promise.
People should be delighted that the EU is now asking them to do exactly that.

17.4 million voted on a promise that our standard wouldn't drop.

It's time for the leader of that campaign and the Prime Minister to sign on the dotted line.

Oh, yes: "The Red Tape Challenge".

It resulted in a LOT of complaints about the Licensing Act and live music, and the main achievements were based on the fact most complaints were not around EU regulation.

The government literally wrote in one of their referendum documents explaining the options outside that this would happen and you all said the government were lying and it was all project fear.

It's not the EU's fault you didn't listen.
Right there in the alternative models guide, and there's more...
The government made it clear the Canada model was based on complex negotiation.

It's not a menu option.

Having looked at the Initiative for Free Trade report into the Japan FTA, I think there may be the disguised suggestion that the government weaken our privacy rights. I haven't had time to look at it properly, but that's how I understand it, and it may be just the start.
So, the report suggests that the EU wouldn't sign up to all the Japanese data provisions, but when I looked at why the EU had been reluctant, it was because they saw data privacy as a 'right', and therefore not for negotiation.
I don't fully understand the political interpretation around privacy rights, but it certainly seems to me like we already have lobbyists openly calling for an erosion of our rights.

The Number 10 brief is no alignment, no concessions, no ECJ, and we want exactly the same deal as the EU gave to Canada. Also that the EU offered this then took it away. On this basis no deal (and also probably no deal with the US) and serious economic damage. Let's unpack... 1/
The fair challenge to the EU is that they suggested the exact Canada agreement could be on offer. But as I wrote 8 months ago, it was only ever going to be available accompanied by rigid level playing field rules. The UK chose to ignore this 2/ ecipe.org/blog/isolation…
The EU could retort that Canada / CETA took years to negotiate and does not remove all tariffs. It includes some alignment. There are level playing field clauses. The UK government have set a timescale that doesn't work for this. ec.europa.eu/commission/pre… 3/

Opening the Brexit debate, Guy Verhofstadt starts by paying tribute to British MEPs who 'always brought wit, charm, and intelligence'. When members of the Brexit Party cheer, he quips 'some of them' to laughs. Hof says: 'In the name of all of us I can only say we will miss you.'
Guy Verhofstadt says it's 'sad to see a nation leaving, a great nation, that has given us all so much culturally, economically, politically, even its own blood in two world wars. It's in fact sad to see a country leaving that twice liberated us.'
Verhofstadt questions what sovereignty is in 21C, citing Huawei. 'Tomorrow there will be Chinese 5G masts in the British islands. The cruel reality is European countries have lost their sovereignty already a long time ago and Europe is the way to regain that sovereignty.'

NEW Brexit slide: This is how the EU wants to structure the EU-UK post-Brexit deal: two bases (economic, security), one governance arrangement, one level-playing field.

We could call it the house at the end of the Barnier staircase.
2. Slide was shown to EU27 diplomats on Friday PM, their wrap-up seminar after Brexit teach-in by Michel Barnier's team.

The slides repeat the EU's now well-known principles…. EU27 unity/ no non member can have the same benefits as a member etc.
3....and all negotiations through Michel Barnier i.e. not via member states.
There has been a fair amount of turnover in EU diplomatic Brexit circles and these seminars have been about keeping the 27 together ahead of the next phase.

So, some tough messaging on level playing field (LPF) provisions coming out of a preparatory meeting between the European Commission and member states today, which I'll try to explain in a thread. Take home message: in the EU-UK trade talks LPF is going to get very dirty...
1/ First big eye-opener is that the European Commission believes that big British firms with subsidiaries in NI will be caught under the ambit of the Irish Protocol if there is no free trade agreement by the end of the year...
2/ Under the Protocol, Northern Ireland remains subject to EU state aid rules. However, the Commission believes that a big British firm with subsidiaries in NI, which might get a bail out by the UK govt, would be subject to EU state aid rules by virtue of the Irish Protocol

EU Commission chief Ursula von der Leyen: 'The more divergence there is, the more distant the partnership will be and without an extension of the transition period beyond 2020 you cannot expect to agree on every single aspect of our new partnership. We will have to prioritise.'
Ursula von der Leyen: 'We are ready to work day and night to get as much done within the timeframe we have. None of this means that it will be easy but we start this negotiation from a position of certainty, goodwill, shared interest and purpose and we should be optimistic.'

I am surprised that the news that HMG is apparently no longer willing to sign up to level playing field conditions, in order to get an FTA with the EU, has not been more commented upon. Since it suggests that they do not in fact want an FTA with the EU.
This is a Brexit whose hardness goes far beyond anything envisaged up until now.
