The top court had earlier expressed an inclination to close the proceedings in Supreme Court and transfer the amount to Kerala High Court so that it decides on the distribution and investment of amount after parties appear in person before the High Court #keralahighcourt
Justice MR Shah: Considering the tribunal order, Republic of India has agreed to the compensation of 10 crores. Republic of Italy has deposited it and it is now transferred to this court's registry
Justice Shah: we are satisfied with the compensation and the ex-gratia paid over and above earlier. This is a fit case to close all proceedings in India under Article 142 of the Constitution.
Justice Shah: Republic of Italy shall now resume the criminal proceedings. We direct that 10 cr lying with this court be transferred to kerala high court registry out of which 4 crore to be paid to the victims each and 2 crore to boat owner
Justice Shah: We order that a judge be appointed by Kerala HC to ensure that the amount of compensation paid to the victims are made available to the legal heirs
Justice Shah: We direct Kerala Govt, Union of India and Republic of Italy to ensure that the criminal proceedings against the two marines is carried out effectively in Italy
AG submitted that a criminal case was filed with Mazgaon Magistrate against MLA Zeeshan Siddique’s Trust and the trustees who were supplying #Remdesivir as they did not have license. No case was registered against Siddique as he had only supplied.
