All right let’s see....

On the topic of the Patriot party:
I see some people saying Trump started it or didn’t. We need it or we should stay Republicans.

I’m just thinking out loud here so bear with me:
“We need to stay in the R party and primary the bad ones”

Well what has the R party (half of the uniparty if you’re awake) really done for us? They barely protect our guns, they obviously can’t protect our speech, they haven’t protected marriage and they definitely don’t care...
About protecting our babies enough to stop [PP]. They had 2 years during 1/2 of Trump’s (still the president) first term and accomplished little. Could have built the wall? Caved. Could have stopped China? Caved. Could have stopped the Rona madness? Caved. The R party is a part..

@frogcycle @StevenBeschloss You’ve nailed it. @glennkirschner2 #TeamJustice has been a mentor, a warrior,a silver lining on a daily basis during these dark days. Glenn knows this country will NOT heal unless a Nuremberg style Trump Crimes Commission to hold those lawless crooks accountable. #JusticeIsComing
@frogcycle @StevenBeschloss @glennkirschner2 I expect those remaining GOP members who survive this election cycle to spin on about the importance of bipartisanship & putting the national nightmare behind us because there’s so much presently important forward, looking matters to address—anything else would just interfere.
@frogcycle @StevenBeschloss @glennkirschner2 Ford let Nixon go—he was surprised it cost him his potus run. I was tender aged, but recall he actually cried. Congressional powers hadn’t the stomach to hold Reagan accountable. And, again we heard the let’s just move forward in a spirit of bipartisanship message. Even Bush Jr.

This is actually an important Q, IMO, Ryan. It sounds like the stuff of crime fiction novels or legal thriller movies, but ... I hope Biden’s transition team has serious discussions about the prospect of seeking an arrest warrant for Trump the minute Biden is sworn in.
Mueller gave us a blueprint for prosecuting Trump. There are several felony obstruction of justice crimes documented in Vol. II of the Mueller report. The evidence supporting those charges FAR EXCEEDS the probable cause showing necessary to obtain an arrest warrant.
IMO, any judge reviewing an affidavit in support of an arrest warrant for obstruction of justice that included the evidence in Vol. II would be obligated but their of office to order the issuance of an arrest warrant. Of course, there are so many other crimes that are similarly

The Stone commutation is invalid & improper. It violates the spirit of the Constitution (even if not the letter of the Constitution). I contend it’s the product of a criminal conspiracy & constitutes obstruction of justice (& a perversion of justice). But here’s the tough part -
How can it be challenged? And by whom? To challenge something in court, you need “standing.” This means you must be personally/directly impacted by the act, in this case, the Stone sentence commutation. Let’s set aside the obvious argument that ALL AMERICANS are affected -
by the Stone criminal commutation because Stone and Trump successfully and nefariously hid from the American people evidence of a president’s criminal conduct resulting in his (invalid) election. Yes, that damages/injures every American and harms the nation. So, we -

Daily we ask ourselves these questions: can Barr be charged for ordering attacks on protestors; can Trump be charged for his reckless/incompetent/intentional mishandling of the COVID crisis resulting in needless/preventable deaths; can Trump administration officials be charged
with crimes for putting kids in cages? As a result of Trump’s unchecked crimes and abuses there are hundreds of other “can they be charged” questions. There is only one fair and accurate way to answer these questions (even if the answer is, at this moment in time, unsatisfying).
The answer is this: if, after a full, fair, nonpartisan criminal investigation there is enough evedince to support criminal charges then the answer is “yes.” The way we handle these criminal investigations beginning in January will go a long way to restoring

Evening All. Here's today's installment of "Prosecuting Trump and Company: A Citizen's Guide." OBSTRUCTION OF PROCEEDINGS BEFORE DEPARTMENTS, AGENCIES AND COMMITTEES, 18 U.S. CODE SEC. 1505. It’s a crime to “withhold . . . oral testimony . . . [from] an inquiry or investigation
[that] is being had by either House, or any committee of either House or any joint committee of the Congress.” How many executive branch officials have blown-off Congressional subpoenas? Under this section, it’s also a crime to wrongfully withhold documents from Congress.
So when, for example, Treasury Secretary Mnuchin withheld Trump’s tax returns - particularly in light of a binding law directing that tax returns “shall” be provided to Congress when a request is made by the Chairman of the House Ways and Means

Evening All. Today's installment of "Prosecuting Trump and Company: A Citizen's Guide", FALSE STATEMENTS, 18 U.S. CODE SEC. 1001. It’s a federal felony to make a “false, fictitious or fraudulent statement or representation . . . in any matter within the jurisdiction of executive,
legislative or judicial branch of the government of the United States.” How’s that for a sweeping prohibition?
This crime applies in various settings. For example, when Bob Mueller’s investigators conducted interviews during the Russia investigation, witnesses who lied
were committing what prosecutors refer to as a “1001 violation.” Think of the now infamous incident of Mike Flynn lying to FBI agents about whether he discussed w/the Russians the possible lifting of sanctions. This law also applies to testimony before congressional committees.

Here's a quick hit on how to STOP Trump from weaponizing the courts. This CAN be done:

The Judicial Fix - Accelerated Dockets for Inter-Branch Governmental Disputes

Trump has successfully weaponized the courts. He knows he can bring a suit in federal court even if
his litigative position is flat-out frivolous. The problem is, even when a court agrees to “expedite” the case, it can take several months to file briefs, schedule & conduct necessary evidentiary hearings & oral arguments and get a final opinion from the court. When Trump loses,
it’s appeal time, which means more briefs, more oral arguments, more delay. Months can turn to years. Once Trump loses in the appellate court, it’s yet another appeal, this time to the Supreme Court. More briefs, more arguments and more waiting. In the meantime,

#JusticeIsComing. In today’s America, that phrase – that promise – is beyond important. It wasn’t so long ago that America suffered through a “long national nightmare.” Politically motivated crimes were committed to give unfair advantage to an incumbent president. A cover-up
followed that was, at a minimum, condoned by that same sitting president. Congress tried to get to the bottom of what seemed like executive branch misconduct only to be rebuffed by a recalcitrant, indeed obstructive, administration. We saw a massacre on a Saturday night.
The Supreme Court decided weighty issues involving the limits of presidential power and immunity. Articles of impeachment were drafted. Ultimately, after declaring, “I’m not a crook,” a criminal president resigned. Then? It was decided that the best way to move forward

An actual president would drop everything, go on TV and address the nation saying, “My fellow Americans, this virus attacking people around the world does not discriminate based on ethincity, nationality, race, religion or orientation. AND NEITHER DO WE!
STOP insulting, demeaning or bullying people of Asian descent! We are one people. Hate, prejudice & division has no place in our country or in our world. Now is the time to unite, to pull together, to rally. Now is the time to support your neighbor, to help your neighbor,
love your neighbor.” But we don’t have a real president. We have a failed businessman and hateful xenophobe who thrives on prejudice and stokes devision for the chaos it creates. Because amidst the chaos, Trump’s corruption thrives. But guess what, Donald Trump, #JusticeIsComing

Hey All. Can we talk about 1 of the few topics I may actually know too much about: homicide? Specifically, whether Donald Trump may have criminal exposure for some level of negligent homicide or voluntary/involuntary manslaughter for the way he’s mishandled the Coronavirus crisis
I spent 22 of my 30 years as a federal prosecutor handling murder cases in Washington, DC. I served as Chief of the Homicide Section at the DC US Attorney’s Office, overseeing all murder prosecutions in the city. I was always on the lookout for novel ways to apply homicide ...
liability in an attempt to appropriately and ethically hold accountable those who were responsible for taking the life of a fellow human being. I think it’s fair to observe that there’s nothing more devestating to a family then losing a loved one to ether violent crime or to ...

1] IMHO.. from what I’ve read/watched/heard elsewhere from numerous sources.. the list near the end of the linked Breitbart article should say “3)Those who abuse children” and there should be a number “4)The victims of 1, 2, 3.” #ThesePeopleAreSick
2] The reference to the “Monsters Inc.” movie is WAY more relevant than most people would know, or want to know once they do. A movie about monsters who compete to scare kids as much as they possibly can to glean power generated from their screams. Sadly, it’s not fiction folks.
3] Look up what Adrenochrome is, where it comes from, the effects that “people” get from it, how it is HIGHLY addictive. Now think about child trafficking & how the kids usually cannot be tracked, and how many 100’s of THOUSANDS of kids (that ARE known about) go missing yearly.

May I offer an optimistic thread to end what was a year of continued Trump corruption, as a way to catapult us into 2020 - that being the last year of a Trump administration? The recent @nytimes article is a game-changer or, as I called it yesterday, a "stop-the-presses" moment.
The Times reported that there was an Oval Office meeting in August, well after corrupt phone call between Trump and President Zelensky in which Trump tried to bribe/extort/strong-arm Zelensky into announcing a bogus investigation into the Bidens. During the August meeting,
some of the highest ranking officials in our government, Defense Secretary Esper, Secretary of State Pompeo and National Security Advisor Bolton, told President Trump that withholding money that Congress designated to go to Ukraine to defend itself against

Come Jan. 2021, there will need to be a commission established to investigate & prosecute Trump, his co-conspirators & those who covered-up his crimes (including elected officials who declared Trump committed no crime KNOWING FULL WELL Trump committed crimes against the US ...
See 18 USC sec. 3, Accessory After the Fact. Also, judicial confirmation hearings - Kavanaugh first among them - will need to be investigated for perjury and judges (esp. those rated “unqualified”) referred to DOJ for prosecution and to Congress for impeachment.
No turning the other cheek this time. The critics and ideologies will cry foul, claiming it’s political vindictiveness. But it’s not - it’s holding criminals accountable at the first available opportunity - when our country once again has a law-abiding president ...

So, if the crime at issue is a continuing crime, like a conspiracy, then the statute of limitations doesn’t start to run until the crime is complete. Remember how Trump was making payments to Michael Cohen to pay him back for the porn star coverup? That means the . . .
campaign finance crimes for which Cohen is serving time continued while Trump was president. So the day he leaves office, Trump can & should be charged w/those crimes (& all other crimes sufficiently supported by admissible evidence). When we again have an Attorney General . . .
who enforces the law instead of protecting/covering up for a criminal president, Trump & so many others will have to charged criminally if we are to restore respect for the rule of law and rebuild the legitimacy of our government. #TrumpCrimesCommission #TCC #JusticeIsComing

His DOJ has seen thousands of innocent young people rescued so far.

Andrew didn't just fly to Epstein's Island... he took his family there too. Ill-judged, indeed.

1. I don’t know WH Counsel Pat Cipollone, but he just signed his name to a letter that will go down in infamy. But the good news is, that letter makes Trump’s removal from office more certain today than it was yesterday, IMO.
2. The White House is done even pretending to care about our laws, including our sacred Constitution. Cipollone’s letter reads like a combination of a grammatically cleaned-up version of the president’s tweets and a legal brief written by someone unfamiliar with the law.
3. It’s a poorly-presented public relations document, an 8-page campaign flyer that will only fool those willing to be duped by misdirection and doublespeak. It’s a disgraceful un-American letter that will stand as an historic low-point for a White House Counsel.

1. Here’s my take on the implications of McConnell’s court packing (please bear with me as it will take a minute). Let’s start with the obvious - it’s bad. But perhaps not as bad as we might fear. Conservative presidents typically nominate conservative judges believing they know
2. how those judge will vote. Let’s take DC Federal District Court Judge John Bates as an example. He was appointed by George W. Bush in 2001. In 2008, Judge Bates decided a case involving a Congressional subpoena that had been served on Harriet Miers, Bush’s White House Counsel
3. Miers claimed that she did not have to testify before Congress because she had “absolute immunity.” Sound familiar? Judge Bates decided the issue and rejected the absolute immunity claim that was put forth by Miers and, by extension, the Bush administration. This is ...
