If you’re arguing that Kavanaugh’s falsehoods and misrepresentations are not technically perjury, you’re missing the point.
Kavanaugh fought to impeach a president over such questions.
1. Um, his sheer hypocrisy...
2... compounds the illegitimacy of hiding his records...
3... compounds his remarkable evasiveness, inconsistencies, and straight-up misrepresentations about his own record on presidential power... e.g. Humphrey’s and his threat to upend independent agencies...
4...which compounds the problem that he signaled about as clearly as a circuit judge could that he’d threaten agency independence just when we need it the most. (For the record, I agree w/ the PHH holding that CFPB design was unconstitutional). slate.com/news-and-polit…
5... which compounds the illegitimacy of a Supreme Court appointment by a president who is directly implicated in felonies (campaign finance etc.) and facing impeachment, and would find Kavanaugh’s views rather convenient. slate.com/news-and-polit…
6...and two big points:
A. No president facing concrete and direct00"" evidence of high crimes and misdemeanors has ever appointed a Justice before. Ever.
And...
7. High crimes and misdemeanors are not the same as felonies. One does not have to commit a crime by the books technically to have abused power. I’m NOT saying Kavanaugh should be impeached, but the technical definition of a felony does not have to be the standard for impeaching.
8. And it is crazy to confirm anyone to a lifetime seat on the Supreme Court until these serious charges are resolved. Maybe he has a good defense, but how can he be confirmed until it is resolved?

9. To put the point more bluntly:
If you feel like you need to defend your party’s nominee from felony charges on narrowly technical grounds...
You might want to re-think your priorities in life.
