To read this piece you would never know there was such a thing as a court of appeal, or that govts had any recourse to them to revisit a wonky lower court ruling.

So many other bizarre assumptions underlying this: that Toronto council is any more “dysfunctional” than most elected bodies; that it would be the job of the province, as opposed to voters, to “fix” it if it were; that cutting council in half would do anything to achieve this...
... that this was such an emergency it had to be done in time for this elexn, though the campaign was already under way; or that any of this nonsense actually had anything to do with Ford’s actions. And that’s before you even get to his use of notwithstanding to push it thru....
It’s all just automatically, unquestioningly accepted, if it is even examined at all.

This is completely wrong. In PR, unlike FPTP, to hold power you have to get a majority of the seats, and to get a majority of the seats you have to get a majority of the vote. PR doesn’t mean the end of majority governments — it’s the beginning. /1
What it does mean, typically tho not always, is government by multi-party coalitions. “Minority governments,” where one party, lacking a majority of either seats or votes, nevertheless tries to nerve its way through, alone, by sheer brinksmanship, are a thing only in FPTP. /2
They’re inherently unstable, but it’s wrong to associate them with PR, not only because minority governments — as opposed to coalitions — don’t tend to happen under PR, but because the political incentives implied by the two systems are totally different…. /3

The pro-NWC position was that Ford had no option in response to a wonky lower-court ruling but to invoke the clause. The anti-NWC position was that of course he had an option: he could just appeal it, as any normal gov’t would.... /1
The pro-NWC response was that appealing on its own wasn’t good enough, because you know what those liberal courts are like and besides there wasn’t time. The appeals court has just exploded both claims, and with them any pretense that NWC was necessary or justified. /2
Every observer could have told you the decision was extremely likely to be overturned on appeal, and equally likely to be stayed while the appeal was heard: a matter of days at most. Only the Ford govt pretended the matter was in any doubt, in order to justify bringing in NWC. /3

I keep seeing this same defence being offered by otherwise sensible people: the notwithstanding clause is part of the Charter and therefore there is nothing unconstitutional about invoking it. /1
The Queen is part of the constitution, too — no law can pass without her assent — but if she started refusing passage of laws willy-nilly it would still be a pretty fundamental constitutional breach. Some things are made to be unused. /2
Decisions to invoke the clause cannot be seen in isolation from one another. The effect of using it once is to make it easier to use it again, and again, and again. When it becomes routine, there will be very little left of the Charter. Yet each use would be constitutional! /3
