OK, there is an addendum to this (and updated story at link above) because the province filed a supplementary factum (written arguments) at the very last minute...
The province now additionally argues that the only scenario that provides the most certainty for the clerk is allowing the stay and the Court of Appeal hearing their actual appeal *after* the election in November. Says that will give everyone time to prepare for appeal
Province also raises the possibility, for the first time, that Bill 31 will not actually be enacted, or that there will be complications (city challenge directed by council)
Province now raises this scenario (stay with me): 1. Stay is allowed (we go back to 47 wards) 2. Bill 31 doesn't get enacted or injunction until after election granted 3. Election held with 47 wards 4. Appeal of Bill 5 is heard and province wins 5. City has to have a new election
Province also, almost amazingly, says that if they lost the appeal, province could still argue to have, say, two councillors per ward or *50* councillors - six more councillors than there are now with a 44-ward council Ford says is inefficient and three more than 47-ward option
